Kim Zolciak’s Mom Takes Her To Court For Visitation Rights Over Her Granddaughters!

Oh, sweet mercy. Kim Zolciak Biermann has gotten two gifts this month: a beautiful new son and a lawsuit from her own mom! Karen Zolciak, who we previously saw getting thrown out of Kim's $1M wedding on Don't Be Tardy For The Wedding is tired of her daughter excluding her from her family.

In retaliation she is taking her daughter to court and demanding she get visitation with Kim's kids! I wonder if the wig collection is also included in the custody decree? 

TamraTattles originally broke the story and discovered that on Tuesday, Aug 28th Karen filed a suit in Fulton Superior Court seeking visitation rights over her granddaughters. The Biermann boys are not included in the filing.

Karen filed "pro se" meaning without a lawyer. According to the filing Karen "is seeking the right to regularly see her granddaughters, who are the daughters of Kim Zolciak Biermann, who is a star on “The Real Housewives of Atlanta."

"The girls live such a crazy, abnormal life being on T.V., they need a normal haven to relax and unwind and just be kids. Plaintiff was portrayed as a bad person on defendant’s show Don’t Be Tardy for the Wedding which featured defendant’s wedding to Kroy Biermann. In addition, plaintiff claims she has not seen defendant’s new baby since he was born.”

It appears that Karen hasn't seen Brielle, 16, and Ariana, 12, since Kim's 11-11-11 wedding where she was unceremoniously escorted out in a golfcart after being derided by the groom. Yes, Karen was acting crazee too. 

I can see Karen's point, in the first three seasons of RHOA Kim's parents seemed very involved in her girls' lives and were often at Kim's house. There did not seem to be any strife between Kim and her mom – at least not portrayed on the show. Enter Kroy Biermann, a spinoff, and a huge over-blown Bravo wedding and all the sudden Karen is pushed to the sidelines.

Maybe that's not what happened, but it's sure what it looks like to this viewer's eyes. I mean all the sudden, Kim's wigs and her rented mansion (that she since was evicted from) seemed way more important as she desperately tried to escape her Big Poppa funded past! 

So the big question is: DOES Karen have legal grounds? According to TamaraTattles (who contacted a legal advisor), possibly if she is able to prove “a history of previous regular visitation.” Which may explain why her petition only lists Kim's daughters. Georgia's Grandparents rights law stipulates that Karen will have a difficult case without proof of previous financial support and because Kim is still very much alive. 

However – neither girl lives with their legal father – or even legally HAS a father – and Kroy has not adopted them. Brielle and Ariana's father is currently in prison on child molestation charges and Kim cut off all contact. 

Kim previously resided with her parents while she was unmarried (pre-Big Poppa) and her mom helped care for the girls. All of these things could factor favorably into Karen's case. 

The interesting thing will be how the girls react. They are both old enough to have independent relationships with their grandmother and advocate for or against that relationship. 

Another interesting thing, this is all happening in the middle of filming for the fifth season of RHOA, where it has been widely reported that Kim pretty much lacks a storyline other than her pregnancy. Which is something we already saw last season. So, I wonder if this will be featured in the show? 

Kim has not addressed the matter on Twitter.
