Joe Giudice Back In Court Again Over Identity Fraud Case; Sentencing Date Finally Set!

October is a big month for Joe Giudice! He’ll be in court October 2nd for sentencing in his federal case, and on October 15th a sentencing is finally scheduled for his identity fraud case!

Today a hearing took place regarding Joe’s identity fraud case where it was determined his federal sentence would likely be linked, or concurrent, with his state one! 

The charges stem from a 2011 DUI arrest, which caused the Real Housewives Of New Jersey star to lose his license after he crashed into a tree while filming for the show.  Joe then used his look-a-like brother Pete Giudice‘s identification to obtain a fraudulent license at the DMV. The case has been on-going for years amid a hub of damning new information, postponed trial dates, Joe’s refusal to accept a plea deal, and finally because Joe and Teresa Giudice were also simultaneously dealing with their federal fraud indictment case.

While Joe’s charges of false identification carry a maximum of ten years in prison a Passaic County assistant prosecutor explains that the case is likely to be resolved through a plea deal with a prison term that would coincide with the same time as his federal sentence. Joe plead guilty to five counts of various financial frauds and looks at 37 – 46 months in federal prison. 

“I am sure we will be able to work this out through a concurrent sentence,” Jay McCann, a Passaic County chief assistant prosecutor, who is handling the case told North Jersey.com. As an Italian national who could face deportation as a result of his federal charges, the state apparently chose to combine Joe’s sentences. 

Superior Court Judge Adam Jacobs described the case as “one of the oldest cases on my docket” and hopes to wrap things up as soon as possible. When Joe is sentenced he will have 45 days to surrender himself to the authorities to begin serving time. 

So, what is significant about this: It looks like the state is certain Joe will be serving federal time, something he and Teresa have been reportedly depending on all along in the hopes she can scrape by with probation or at the very least, house arrest.
