Good news and bad news for Teen Mom star Amber Portwood as the Indiana Child Protective Services has now closed its investigation against her.
The bad news? Her baby daddy Gary Shirley was awarded primary physical custody of their 3-year-old daughter Leah. “Today amongst all days is the single greatest day for the rest of my life:)…My daughter officially mine. More than before. Love you so much @leah_leann so were hitting up some Disney in Florida to celebrate. ” tweeted the classy Gary yesterday. And just in case you forgot, yes, Gary did open up a Twitter account for his 3-year-old.
Gary’s lawyer Jeff Lockwood also confirmed the news to Hollybaby. “Today the Department of Child Services dismissed their case against both parents,” Jeff stated Wednesday. “Now that DCS is out of way, regular court order comes into play.”
So what does this mean for Amber, 21? Jeff explains, “Gary is the primary custodian which means he has custody of Leah and Amber has visitation rights.”
Jeff adds that Leah will be with Amber every other weekend, Friday through Sunday, while alternating holidays and time in the summer with Gary.
While Amber admits Gary now has primary physical custody, she gives an interesting explanation to E! Online. “Gary and I have joint custody and Leah only lives with him because they [CPS] felt she wasn’t safe with me when my house got vandalized,” states Amber.
Amber also adds that Gary and her are doing much better as co-parents to Leah. “We’re getting along fine, not fighting,” she said. “Everything is finally good.”
The investigation by Child Services began last year after MTV aired footage of Amber physically attacking Gary in the presence of their daughter, Leah. In fact, Amber was arrested for domestic violence and ultimately received a suspended two-year sentence, plus two years of probation. Amber has had an especially hard time in the past year which included a suicide attempt back in June followed by a 2-month stint in rehab.

TELL US – IS LEAH BETTER OF WITH GARY? OR SHOULD AMBER HAVE REGAINED CUSTODY?
In the latest incident RadarOnline is reporting that Amber was caught instigating a fight and scrapping with a woman at an Indiana IHOP last month. All class, no trash there! “She was drunk, and there was another girl in the restaurant who had been drinking too and apparently said something about Amber to her friend,” a source revealed to Star magazine.
“Amber instigated the fight,” the source adds. “She told the girl, ‘You don’t know anything about me! I’m gonna whup your ass!’ They just attacked each other.” In the video, Amber is seen wearing a white t-shirt and flailing her arms in the air before she straight up charges the woman. A photo of an irate Amber during the incident is below.
“There were a couple punches thrown and hair pulling, then they were separated,” the witness reports. No word if charges were filed or not, but I imagine they were asked to leave the restaurant…
Amber has announced that her often erratic behavior can partially be explained by bipolar disorder, which she was diagnosed with three years ago.
Speaking to E! News, Amber opened up about her diagnosis and how it affects her life. “I struggle with it. I hate it. I grieve over it,” she shares. “When I went to rehab for two months, they diagnosed me with dissociative disorder too, which makes me black out. People don’t understand what it’s like.”
Despite the struggles, Amber reveals things are looking up for her in life (really? see above?) as she now has a new boyfriend, Mike who she adores. “He’s a gorgeous man. We haven’t spent a day apart since we met,” she says.
“I always knew I wouldn’t be with [baby daddy] Gary for the long term,” Amber confesses. “But with Mike, I know he’s the one. We never fight. He balances me out.” The couple has been seeing each other for about a month.
And speaking about the Nov 18 dispute at IHOP, Amber insists she did not start the fight! “Yes, we did go have a couple of drinks,” she admitted, saying she was with her new boyfriend Mike. “But I was not drunk. We were sitting by ourselves, laughing and talking and my legs were up on his, just having a good time. Suddenly, I hear this couple make these racist comments.”
“I looked over and said, ‘Excuse me, but why are you starting drama? Please do everyone a favor and keep your comments to yourself,’” adding that the comments persisted. “So that’s when I got up and told her to shut her f–king mouth.”
Amber explains she hates being approached in public because she is often made fun of based on what audiences see on TV.
“I’m sick and tired of people bashing me every time I leave my house,” she snapped. “When I go out, I mind my own business, but people try to fight me and get me going because I guess they think I’m most famous for fighting Gary,” Amber laments.
“I get picked on every time I go out in public. I just want to be a normal 21-year-old. I do my duties, I take care of my child. Yes, I did hit Gary, and what people saw was an angry Amber who reacted to the father of her child telling her he had cheated on her.”
“People pick on me just to see if I’ll fight them. They think I’m this hard person, but I’m not! I’m a good person. I love my friends. I love people… I just want people to know that people change. I’m doing really well. I’m happy. Yes, I am on an MTV show, but I deserve a normal life, too. People need to realize that the show, Teen Mom, is on TV just to help others not make the same mistakes. That’s it.”

In a new interview with E! Amber, 21, reveals she, like many others, was not surprised the marriage between Kim, 31, and Kris Humphriesled to divorce. “I don’t think anyone was surprised,” said Amber.
Amber then goes on to make it clear she can relate to Kimmie because they are so totally a lot alike! “I mean it is heartbreaking, but Kim and Kris are like Gary [Shirley] and me. Total opposites,” noted Amber. “One is a diva and the other is a down-home guy.”
Kim Kardashian Jr. also explained why she calls herself a diva! “Well, Janice Dickinson told me I’m a diva, so I guess I’d have to say I’m the diva,” laughed Amber. Okaaay.
As for the current state of her relationship with baby daddy Gary Shirley, Amber reveals the two are working on finally becoming adults becoming better co-parents to their daughter, Leah. If you recall, they are currently broken up for the week time being. In fact, the two are working together to plan a birthday bash for little Leah who turns 3 next week! (She’s already 3?)
“We’re having a giant bash for her,” said Kimmie Jr. “It’s going to be all princess-themed. She’s going to be Cinderella. Gary and I realized that it’s all about Leah. It’s not about what he wants or what I want. It’s her day.”
In Amber’s defense, Kim and her do have a lot in common as they are both famous for being famous and lacking any known talent!

TELL US – THOUGHTS ON AMBER’S COMMENTS? IS SHE A LOT LIKE KIMMIE?
Three months after her widely reported suicide attempt, Teen Mom star Amber Portwood is now opening up for the first time and in a shocker, she reveals she is “still suicidal.”
While talking to E! News, Amber, 21, reveals she was rushed to the hospital last Wednesday after suffering a severe panic attack. “I couldn’t breathe and I passed out,” says Amber. “I stopped breathing.”
Amber, who continues to make tabloid headlines with baby daddy Gary Shirley, then goes on to state she is still having a hard time despite spending weeks at a rehab facility in Malibu.
“Honestly, I feel like I did two months ago. I’m still suicidal,” Amber reveals. “I’m f–king depressed. My family’s not together.”
Amber goes on to add that she is very upset at all the tabloid headlines, most notably the recent Life & Style magazine cover story which stated she is choosing partying over spending time with her 2-year-old daughter Leah. The mag even managed to get quotes from Amber’s own brother Shawn Portwood who stated that Amber “enjoys her freedom too much right now.”
“What hurts me the most is when people believe the lies about me,” Amber tells E! News. “The bullying is too much to handle. Look at the rate of teen deaths related to bullying. It’s scary.”
Amber also makes it clear that she doesn’t have a drinking problem and that she did not go to rehab for such. “I went to rehab for depression and anger management, not drug or alcohol abuse,” says Amber. “I have been out twice since I left rehab and I’m 21. I take my medication the way I’m supposed to.” Amber revealed last year that she suffers from bipolar disorder.
As for not seeing her daughter Leah, Amber reveals she agreed to let Gary have custody in other “to keep CPS off our backs.” She adds that she tries to see her daughter as often as she’s allowed. “I see Leah whenever I can. I have stipulations as to when I can and can’t see her.”
TELL US: SURPRISED AMBER’S STILL SUICIDAL? SHOULD SHE QUIT TEEN MOM? SHOULD MTV STEP IN?
According to the latest issue of Life & Style magazine, troubled Teen Momstar Amber Portwoodis very well headed for another breakdown.
Following her arrest last December in addition to a suicide attempt this summer which led to a 2-month rehab stint, the mag is reporting Amber, 21, is drinking and partying more now than before. And the source of the story is none other than Amber’s brother Shawn Portwood.
According to Shawn, Amber is spending more time out partying than she is reconnecting with her 2-year-old daughter Leah. “At least three times a week, Amber will go out to bars and clubs,” Shawn admits to Life & Style.
“Amber could see Leah every day, but she sees her maybe three times a week,” adds Shawn. “I don’t even know if Amber wants full custody of Leah. She enjoys her freedom too much right now.” As reported, Amber’s baby daddy Gary Shirley, who admitted last month that he was homeless, currently has custody of little Leah.
On Sept. 15, Amber was spotted at 59th Street Pub in Anderson and again on Sept. 27 dancing and downing beers at Jimbo’s Pub and Club in Anderson, Ind. “My friends were there and said she drank near a whole bottle of white wine,” reveals Anderson local Shane Butt. “She was kissing her new boyfriend [Jesse Stone] and even posing with her bottle of wine. It seems like rehab didn’t help too much.”
Shawn adds that Amber would rather be out at bars seeking attention from the Anderson locals than spending time with Leah. “She likes to go out where people see her and recognize her,” shares Shawn. In Amber’s defense, previous reports have stated she’s only allowed to see Leah twice a week during supervised visitation so perhaps partying is her unhealthy way of dealing with not having custody of her daughter.
While Amber is said to be dating new beau Jesse Stone (pictured below), Gary tweeted days ago that Amber was still trying to get back together with him. Gary wrote, “Spent a Lil time with Amber, just goes to show me that our relationship is like a burnt log and it can’t be relit.”
He then added: “I said no to her on getting back together she cried so I gave it some thought and she started calling me names like trash ect.” Gary broke up with Amber three weeks ago after getting a giant tattoo of her name on his back. He accused her of cheating of him.

TELL US – THOUGHTS ON THE LATEST WITH AMBER AND GARY? DO YOU THINK SHE’S HEADED FOR ANOTHER BREAKDOWN?
Last night we bid a final farewell to MTV’s original Teen Mom cast. Well, not technically final, because I’m sure they will keep filming this train wreck as long as their are folks like me to watch it!
The finale resumes with a saddened Amber rejoining her mother on Dr. Drew’s sofa after the doctor goes to speak with her. At the end of the first half of the reunion Amber had stormed off stage because she was so upset discussing her younger sister’s death from SIDS when Amber was four years old. Dr. Drew assures Amber that SIDS is sadly a common killer of infants and no one is to blame.
Amber’s mother remembers that the mother-daughter relationship was very stressful before Amber got pregnant. Dr. Drew uses Amber and her mother as a tutorial for parents who are concerned about their child’s sex lives, discussing how to overcome the awkwardness of broaching the subject of sex with one another.

It’s the first half of this season’s Teen Mom reunion, and of course, Dr. Drew Pinsky is hosting to give his insight and expertise. Thank goodness, because we all know these ladies need it!
Dr. Drew introduces the original Teen Moms, and they all look pretty awkward. He asks them what kind of reaction they get from the public after being back on the show. Maci reveals that she has a lot of older women who were teen moms approach her to say the show helps them broach the subject of sex and parenthood with their children. That’s good, as it is supposedly the point of the program. Amber says she gets mainly negative feedback given the drama that has been a part of of Leah’s upbringing. Farrah gets good feedback, but she seems very out of it with her answer. Catelynn explains that she has many fans approach her about her choice of adoption. She even says that she went to the hospital with a girl who had chosen adoption for her baby because the baby’s father had left her alone with the difficult decision.
Dr. Drew, much like me, feels very proud of Catelynn’s impact. He shows a two minute montage which sums up the entire season. Really? Could I have just watched this Cliff Notes version instead of having to see poor Michael be ridiculed or Gary try his hand at singing?

Last night’s season finale of Teen Mom was another super-sized episode that had each member of the franchise making very difficult decisions. Will Farrah take Sophia to Florida (thanks Life & Style for being a spoiler!)? Will Carly come to Catelynn and Tyler’s graduation? Will Amber reconcile with Gary? What will become of the Maci-Kyle-Ryan drama trifecta?
It’s Sophia’s second birthday, and Farrah wants to put the family stress of her impending move aside for her party. She walks into her parents’ home and her father greets her warmly. “Shut the hell up, MICHAEL!” she screams. Way to put the stress behind them. At lunch, Farrah’s mom brings up how much pain her daughter was in during labor. None of them seem to remember the day of her birth in anywhere near the same manner, but whatevs. Happy birthday, Sophia! Welcome to the cra-cra!
