Just months after being forced to pay over $22,000 in attorney fees to her ex-boyfriend Jay Photoglou, RadarOnline is now reporting Orange County Superior Court Judge Gregory Munoz tentatively ruled on Wednesday that Jay be awarded fees and costs of $40,799.38 as a result of an anti-SLAPP motion he filed. The official ruling is expected to be finalized any day now.
This all stems from Jay’s lawsuit against Gretchen for libel, slander and five other counts. “We filed a motion for attorneys fees asking for $80,000 knowing, the truth is, the best we could do is probably get half that because we won half the motion,” Jay’s attorney Bryan J. Freedman told RadarOnline.
Gretchen, who filed a counter suit against Jay for defamation, suffered another legal blow two months ago when the same judge threw out a huge portion of her lawsuit against Jay, including claims of defamation, slander and portrayal in a false light.
Jay is also suing Gretchen for defamation. Jay’s case stems from Gretchen’s claims that she was never romantically involved with him though the countless number of photos leaked out by him show otherwise.
“But the good part is she’ll be writing a check for $40,000 or be held in contempt of court,” Jay’s attorney added.
In other OC news, it seems there’s yet another bankruptcy to report. According to Jezebel.com, Simon Barney, estranged husband of Tamra Barney, filed bankruptcy on December 2, 2010. While no additional details were reported, the site reveals it was chapter 13 bankruptcy. We will bring you more details as soon as we get our hands on it.

The judge struck down Gretchen’s claims of defamation, libel and portrayal in a false light after determining that her lawyers hadn’t offered up enough evidence to prove that Jay was lying about the two of them being in a romantic relationship while she was engaged to Jeff Beitzel, who died of cancer in 2008.
Gretchen is however still allowed to pursue prior claims of assault, battery, stalking, breach of contract, conversion, intentional emotional distress, intentional interference with contractual relations and intentional interference with prospective economic relations against Jay.
Gretchen’s attorney Gregory G. Brown says he is considering an appeal. This ruling comes months after Gretchen was forced to fork over $24,000 to cover Jay’s legal fees after he took her to court for defamation.
Gretchen told UsWeekly magazine, “I was truly sorry to hear the news.” She added of Vicki, “She’s been having a really tough couple of days.”
Gretchen shares she sent Vicki a text message of support after the announcement. “I’ve talked to a few people in the inner circle and it’s a bad situation for her right now.” According to Gretchen, the split came as a surprise. “It kind of took us all by surprise, because from what I knew…things were going well, so I don’t really know what happened. It’s very sad.”
In fact according to RadarOnline and E! News, Jeana was the one who provoked the physical altercation with Tamra by trying to push her into a pool unsuccessfully.
RadarOnline reports that Tamra was furious with certain comments Jeana had been making about her in the press, comments which she felt were inaccurate, so she tried to hand Jeana a cease and desist letter from her lawyer at a wrap party for the Bravo show. The party took place at castmate’s Vicki Gunvalson’s house according to E! News.
That didn’t go so well according to Radar. “Jeana said to Tamra, ‘Youre’ a b—- and I’m gonna throw you’re a– in the pool,'” a witness tells Radar. “Then she pushed Tamra, as if she was trying to throw her in the pool.”
This then led to Tamra throwing a glass of wine in Jeana’s face, and as Tamra walked away, Jeana attempted to throw her wine at Tamra, but the drink ended up missing her, instead soaking another woman’s white dress. That woman reportedly grabbed Jeana and pushed her up against a wall.
It wasn’t over yet folks as Tamra then encountered Jeana and a male friend in the driveway as she tried to leave the party. Jeana’s friend then took a wine glass and threw it at Tamra’s feet, with glass shattering and flying everywhere.
Bravo’s cameras were reportedly on hand to film the event.
In other news, the AbsurdToSublime site is reporting that Gretchen Rossi is now engaged. According to the site, her boyfriend of a year and a half, Slade Smiley, proposed to her Saturday night during the filming of the Season 6 Real Housewives of Orange County Finale.
If true, no official announcement yet from either party, though Gretchen did post a photo of she and Slade with their parents over the weekend. We’re guessing the announcement will likely come from a major media outlet like Bethenny Frankel did with PEOPLE magazine when she got engaged. The site also reports that Slade recently had his vasectomy reversed.
Pictured above is Peggy Tanous and husband Micah Tanous on their wedding day. Radar is reporting the Alexis Bellino clone Peggy has joined the cast and has even began filming scenes with the other housewives.
Oddly enough, Peggy is said to be a friend of Alexis Bellinowith insiders describing her as being “truthful and blunt” and someone “who always tell it the way it is.”
Peggy’s husband, Micah, is described as being an internet entrepreneur. Peggy and Micah have two daughters together.
According to Radar, Peggy will be joining existing cast members Vicki Gunvalson, Gretchen Rossi, Tamra Barney and Alexis Bellino. Lynne Curtin’s name was left out of the list, could she be off the show? Only time will tell.
Well it seems Gretchen is now set to launch another new random business venture her handbag collection at the end of this month. According to Gretchen’s website, the Gretchen Christine Collection (Christine is her middle name) will include a collection of designer handbags, shoes, fashion and accessories available in limited quantities at select retailers.
Her blog also announces Gretchen will debut her new collection July 30th on Shop NBC @6pm. There will be “seven styles to choose from all at affordable prices-ranging from $129 to just under $300 dollars! Happy Shopping!” says Gretchen on her blog.
The latest in the never ending drama of Slade Smiley’s child support case is a new report detailing what took place during Slade’s hearing on Friday. RadarOnline reports that Slade, 41, owes between $84,962 and $110,000 in back child support to Michelle Arroyo, mother of his son Grayson Arroyo-Smiley, 10, who suffers from a rare form of brain cancer.
The drama ensued when Gretchen’s ex-boyfriend Jay Photoglou, who is not a stalker by any means, decided to show up to the court hearing for some strange reason. Is it safe to assume Jay has no job and has lots of free time to show up to court cases that have absolutely nothing to do with him? This made Slade furious and authorities had to step in to keep the parties separate.
Slade is then said to have asked the judge to have Jay removed the courtroom, which led to all parties not directly involved in the case being asked to leave court, including Gretchen.
And according to the OC Register, Slade who is said to be a former insurance salesman and male model, admitted in court he had received some payments for this appearance on the OC Housewives. This is despite Slade’s previous claims that he had zero income and zero expenses. Slade also admitted he had the funds paid to Gretchen and then re-directed to him to avoid mandatory deductions.
Slade has asked the Judge to reduce his child support payments, and is due back in Court in September.
