Federal prosecutors are attempting to block Teresa Giudice's primary defense tactic to be tried separately from her husband Joe Giudice. Teresa and Joe's reasoning behind the petition for separate trials is a clause known as "marital privilege" which states spouses are not required to tell incriminating information against each other. Prosecutors argue that any voluntary testimony disbands that right.
In a 47 page memorandum presented to the judge on Wednesday, prosecutors argued against the Real Housewives of New Jersey stars' attempt for separate trials, stating: “Teresa and [Joe] appear to share the hope that each may have a better chance of acquittal in a separate trial … This, however, is not sufficient basis to sever two defendants charged as participants in the same conspiracy and fraudulent scheme.”
If you recall, the Giudices' alleged defense scheme is to make Joe take the fall by claiming Teresa didn't know what she was signing. Joe maintains that he wants a separate trial so he can testify in support of this notion that he was the "brains" (HAHAHAHAHA) behind the schemes while Teresa was an innocent victim.
With all the legal disasters currently populating Teresa Giudice's life at least one thing is going in her favor – she won't have to move her kids out of the marble remnants tackery she refers to as home. Whew!
A bankruptcy court recently ruled that the Real Housewives of New Jersey star will not have sell her home to repay debts. Radar Online discovered court documents pertaining to the case where the trustee of Teresa and Joe Giudice's home filed a motion on December 23, 2013 for the Giudices to "abandon" their home because it's of “inconsequential value” to their estate.
Translation: it would be too difficult for the trustee and the state to handle the sale of such a garish property so it's worth more in the Giudice's hands (with them presumably paying property taxes and a mortgage) that it is being sold outright to pay off old debts since it would not generate enough money to make a significant dent.
Well, after some quiet time where their federal fraud trial is concerned,Teresa and Joe Giudice are keeping their attorneys busy in the new year. And while the attorneys are hard at work, the Giudices were off at play.
Joe's attorney filed a motion late last week, hoping to split Joe and Teresa's charges into two separate trials. Joe is hoping to take the blame for most of Teresa's signatures, etc., from the way it reads. They're also asking for information from the prosecution as to what particular pieces of unedited footage from The Real Housewives of New Jersey will be used against them.
