Legal Experts Predict Diddy’s Prison Sentence Ahead of Official Sentencing — Exclusive

Sean “Diddy” Combs will face sentencing on Friday (October 3, 2025) for his prostitution-related charges. His defense lawyers think that he should be freed based on time served. Prosecution in the case, however, are asking for an 11-year stretch. Reality Tea got in touch with four legal experts to give their predictions ahead of Diddy’s sentencing. Their responses are telling; this one really could go any way…

What will Diddy’s sentencing look like?

Criminal defense and civil rights attorney Adanté Pointer said:

“Diddy is technically facing punishment for paying for consenting adults to travel for sex although federal law allows the judge to consider collateral facts such as the domestic violence and drug issues raised in the course of the trial. I predict Diddy will essentially be sentenced to time served with a possibility of being sent to a federal halfway house for him to complete drug abuse counseling for a year or less. That sentence is consistent with the fact the government came up empty handed after fumbling the much more serious charges.”

Former federal prosecutor and president of Los Angeles-based West Coast Trial Lawyers, Neama Rahmani said:

“I think Diddy is going to get close to five years in prison. That is within the four to five year range the prosecution originally mentioned after the verdict, and the five to seven year range recommendation by U.S. Probation. The government’s new, 11 year recommendation seems like sour grapes and piling on, especially because it is more than the 10 year statutory maximum on one of the prostitution counts.

“I don’t think Judge Subramanian will run the sentences consecutively. I also don’t think Subramanian will give Diddy a sentence of time served or close to it, like the defense is asking. It was telling when he would not release Diddy on bond even after he was acquitted of the most serious counts of racketeering and sex trafficking. Judges often split the baby in these cases, which is why I think Diddy ends up somewhere in the middle of the prosecution and defense recommendations.” 

Los Angeles entertainment attorney Tre Lovell said:

“Diddy was convicted on two counts of transportation to engage in prostitution, each with a maximum sentence of 10 years. Since this is Diddy’s first offense, and these crimes are essentially consensual, non-violent crimes, I would normally expect a lighter sentence of between two to three years, however, the judge can consider a number of other factors, including the defendant’s conduct, that may not have been part of the convicted offense. In this case, the judge has made it a point to raise concerns about Diddy’s prior violence, especially directed at Cassie Ventura, which his attorneys had admitted in court. This is why the judge refused to allow Diddy out on bond pending sentencing.  I believe that these concerns will carry over to sentencing, and increase Diddy’s time in prison to three to five years.”

Sam Bassett, criminal defense attorney with Austin, Texas-based Minton, Bassett, Flores & Carsey said:

“I believe the judge not releasing P Diddy on bond pending sentencing on the lowest of the charges sends a signal that he is not going to “go low” in his sentence. However, the sentence will be determined by the Sentencing Guideline calculations provided to the court by U.S. Probation, not the statutory sentence of 10 years per count. It is clear that the defense will argue for a “time served” sentence of about 14 months. The Government will likely ask for something as close to the 10 year sentence as possible, taking into account the Guidelines. I do predict at least a three year sentence and perhaps as much as five years based upon the collateral facts that came out during the trial about P Diddy’s violence and control toward others.”
