Mark allegedly got into a fight with a 69-year-old delivery driver in the early hours of Saturday morning. The driver claims that Mark approached him angrily regarding his choice of parking spot, reports TMZ. The men reportedly got into a scuffle, and the driver pepper-sprayed the former NFL quarterback.

According to the driver, when the spray didn’t work, he stabbed Mark multiple times in self-defense. Both men were taken to hospital. After CCTV footage was reviewed, the athlete was arrested. He was initially hit with three misdemeanor charges – battery resulting in injury, public intoxication and unlawful entry of a motor vehicle.

Now Marion County Prosecutor Ryan Mears says that the ex-New York Jets signal-caller is facing a Level 5 Felony battery involving serious bodily injury charge. If found guilty, he could see a sentence of one to six years. The prosecutor explained that new details about the alleged victim’s condition justified upgrading the charge.

Meanwhile, IMPD Chief Chris Bailey says the star won’t receive preferential treatment. He said: “I don’t care who you are, I don’t care what you do for a living, I don’t care where you live – if you come into our city, commit violence, we will use all the tools at our disposal to hold you accountable,” per TMZ.
