Donald Trump is reportedly seeking to reclaim the $5.6 million that the court ordered him to pay E. Jean Carroll. The president had to make the payment after a federal jury found him liable for sexual abuse and defamation.
Donald Trump wants E. Jean Carroll to return the money
According to a Tuesday report by The Independent, Donald Trump is seeking an emergency injunction that would order E. Jean Carroll to return the $5.6 million she received from the president two weeks ago. Trump was ordered to pay the amount to Carroll after a federal jury found him liable for sexual abuse and defamation. The money went to Carroll on July 9 from a court-controlled escrow account.
In a legal filing on Monday, Carroll’s lawyers wrote, “But rather than accept the reality that he had lost, [Trump] has engaged in a series of maneuvers trying desperately to forestall payment.” The $5.6 million payment to the former Elle magazine writer “should have been the end of this case,” her legal team said. However, Trump now wants the money back.
“But Defendant now demands yet another unprecedented remedy. … The judgment here is final, the money has already been disbursed, and Carroll is entitled to keep it.”
Carroll’s lawyers rejected the president’s request for the injunction, calling it “procedurally improper, substantively meritless, and yet another example of Defendant’s pattern of ‘slow-roll[ing] his defenses, asserting or inventing a new one each time his prior effort to delay the case fails.’”
Trump made the payment after a New York civil jury found him liable for sexually abusing and defaming Carroll at a Manhattan department store in the 1990s. “Defendant has been stalling this case for years,” Judge Lewis Kaplan wrote. “A jury unanimously concluded that he sexually abused and defamed plaintiff and awarded her damages accordingly. The judgment on that verdict has been upheld on appeal.”
