Kourtney Kardashian’s Lemme in Legal War With Cigarette Brand — Report

Kourtney Kardashian‘s Lemme has reportedly been caught in a legal battle with a cigarette brand of the same name. For the unaware, the model’s brand is a vitamin and supplement line. On the other hand, the other one is a cigarette and e-cigarette supplier based in China. According to a source, Kardashian’s brand has filed an opposition to the other company’s trademark application.

According to documents obtained by The Daily Mail, Kourtney Kardashian’s Lemme is embroiled in a trademark dispute with a cigarette brand. The gummies brand has reportedly filed an opposition to Hong Kong Senran Technology Company’s Lemme trademark application. According to documents, the company is claiming that “priority and likelihood of confusion” and “dilution by blurring” are grounds for opposition. Lemme is allegedly opposing goods and services, including cigarettes, cigarette filters, cigarettes having tobacco substitutes, and electronic cigarette atomizers.

The other things are electronic cigarettes and liquid nicotine solutions for use in electronic cigarettes. Additionally, the documents mention, “‘consumers have come to recognize LEMME as identifying the source of high-quality vitamins and vitamin supplements that originate from Opposer [Kardashian’s brand].” Moreover, they state that the other Lemme’s mark is “identical and/or confusingly similar to each of the Lemme Marks.”

“Any dissatisfaction with [Lemme Hong Kong] goods will’ irreparably damage the reputation of [Kardashian’s Lemme] .” they continued. Kardashian’s brand also claims that the Hong Kong brand is “likely to cause dilution by blurring and tarnishment of Opposer’s famous mark LEMME in violation of the anti-dilution provisions’.” As such, the Hong Kong Senran Technology Company filed its response.

The company reportedly denies that the gummies brand “has been or will be damaged” by the application of their trademark. “Opposer’s dilution claims fail as a matter of law because [Kardashian’s Lemme] has not established its marks are famous to the general public of the United States, as required under the Lanham Act.” The company added, “There is no likelihood of confusion between Opposer’s marks with Applicant’s Application due to the significant differences in the respective goods and their respective channels of trade of each party, and the absence of any relatedness of the parties’ goods.”
