Harvey Weinstein’s New York Retrial Opens Again

Harvey Weinstein’s rape retrial commenced on Tuesday, April 21, 2026, in a New York City courtroom, marking his fourth rape trial in six years. The former Hollywood producer has been accused of assaulting Jessica Mann, who has testified in two previous trials that Weinstein raped her at a Manhattan hotel in 2013. Weinstein was previously convicted in this case, but the verdict was later overturned.

Harvey Weinstein, one of Hollywood’s most controversial figures, was wheeled into a New York City courtroom on Tuesday, April 21, 2026, to face his fourth rape trial (via Variety). The case, which emerged during the #MeToo movement, remains unresolved nearly eight years after the former movie producer’s arrest.

Weinstein has been accused of raping Jessica Mann, an aspiring actress. She testified against him in the previous two trials. There, she stated that the producer raped her in a Manhattan hotel room in March 2013.

Before this ongoing retrial, Weinstein was convicted of third-degree rape involving Mann in 2020. The verdict was later overturned by the state’s highest court. In a retrial in 2025, Weinstein was found guilty of assaulting another accuser, Miriam Haley. However, the charge involving Mann resulted in a deadlock, leading to another retrial.

“This case will come down to power, to control, and to manipulation,” Manhattan Assistant District Attorney Candace White said to jurors in the opening statement. “In 2013, the defendant believed it was his world and everyone else was just living in it.”

Mann reportedly met Weinstein at an engagement party in February 2013, roughly six weeks before the alleged assault.

Defense attorney Jacob Kaplan, meanwhile, argued that the case is about “consent and choice.” He referenced email exchanges between Mann and Weinstein. “This case will be her word against her own word,” Kaplan said.

The trial is expected to run into the second week of May.

Weinstein has already been convicted of raping an Italian model in a trial in Los Angeles in 2022 and was sentenced to 16 years in prison.
