Trump’s filings, obtained by TMZ, argue Carroll’s attorney told the court the funds would go into an “interest-bearing account” once they left judicial control. He says the story shifted after she collected. Her legal team later disclosed the money sits in a personal investment account earmarked for her retirement.
His lawyers asked how she defended the move. Carroll’s side pointed to the S&P 500, which Trump’s attorneys argue exposes the E.Jean Carroll payout to market losses and leaves it subject to her “whims.”
He wants the appeals court to order the full amount back into a court-controlled account while his Supreme Court challenge continues. His filings raise the possibility that Carroll could pass the money to third parties, making it hard to recover if the judgment falls.
Carroll’s team disputes the premise. They say the money remains intact and argue a rehearing petition is not reason enough to claw back a judgment she already collected.
The payment itself came through earlier this month, totaling $5.62 million. It followed the Supreme Court declining to take up Trump’s appeal of the 2023 verdict that found him liable for sexually abusing and defaming Carroll.
His attorneys maintain the Donald Trump lawsuit has further to run. For now, they want the money out of the market and back under court supervision.
