After her Memorial Day weekend DUI arrest, Lindsie Chrisley promised that she would “fight the charges.” Just like clockwork, her defense strategy has arrived. She’s not going down without a fight!
The oldest daughter of Chrisley Knows Best star Todd Chrisley is following in the footsteps of the rest of her family and arguing that her arrest should never have happened in the first place.
In a new legal motion, she’s asking the court to toss out all of the evidence.
The TV personality’s lawyer claims evidence was “illegally obtained or seized” from her arrest
According to new court docs reviewed by Us Weekly, Lindsie and her team filed a motion to suppress all evidence seized during last month’s arrest. Her lawyers claim that whatever the cops found was improperly obtained “due to a lack of probable cause to seize the items.”
“There existed no probable cause for an impoundment and inventory search of the property,” her lawyer asserted.
Additionally, Lindsie and her team argued that the cops executed this “warrantless search” at “an unreasonable time” and did it without “valid consent.” They also claimed that the officers used “excessive force.”
Although Lindsie and her legal team argue that the cops didn’t have a right to search her, the original police report offers more details on why they pulled her over in the first place. The cops claimed they saw her speeding down the road, tailgating someone, and flashing her high beams. Supposedly, she was going upwards of 90 miles per hour.
When they pulled her over, she was allegedly slurring her words, and they smelled alcohol on her breath. She refused to do a field sobriety test.
Lindsie, on the other hand, had a completely different story. She said the car in front of her almost hit an animal, and she sped around them to avoid an accident. She’s facing charges of DUI less safe, attempting to elude police, improper passing, reckless driving, and speeding. A judge has yet to rule on her latest motion.
