The Elon Musk-founded company xAI has filed a lawsuit against the state of Minnesota over an upcoming law that bans ‘nudification’ technology on websites and apps. The documents filed by the SpaceX subsidiary argued against a slew of aspects mentioned in the law rather than opposing the charter in its entirety.

In a report by AP News, on July 27, xAI sued Minnesota for issuing a law that extensively bans the usage of AI in the creation of fake nude images of real people.
The 38-page lawsuit filed by Elon Musk’s company did not challenge the state for trying to outlaw the increasing circulation of AI-generated nude images of real people without their consent, as per AP News. Instead, it claimed that the Minnesota law, which is currently on track to come into force on August 1, “extends far beyond that goal” and also embargoes constitutionally protected AI images and video.
The case further states that the ruling snatches away any “safe harbor” for organizations that actively implement regulations to prohibit users from creating such illegal content. Additionally, the lawsuit filed by Elon Musk’s xAI notes that the law also includes AI images that have been approved by the depicted individual, as well as ones generated by the person themselves.
Moreover, the lawsuit disputes the definition of ‘intimate part’ mentioned in the Minnesota law, arguing that it even covers body parts that people routinely put on display without any backlash.
Responding to xAI’s lawsuit, Minnesota Attorney General Keith Ellison noted that his office has not received the case filed by Elon Musk’s company. He added, “I know that using AI to generate nude images of people against their will is appalling. There are plenty of worthy debates to have about AI policy. This is not one of them. AI nudification robs the target of their dignity and can cause immense harm on an emotional, personal, and professional level.”
