The former couple now share daughter Scottie Rose, and according to one family law attorney, creating a workable co-parenting arrangement may prove more complicated than a typical custody case.
That’s largely because both parents have demanding careers, busy travel schedules, and ties that extend beyond a single city or even a single country.

The “Saturday Night Live” alum and the model welcomed their daughter less than a year ago. Since announcing their split, questions have surfaced about how the pair will navigate custody and parenting responsibilities moving forward.
Family law attorney Frank L. Perrone, Jr., Co-Chair of the Matrimonial & Family Law Practice at Tarter Krinsky & Drogin, recently weighed in on the situation in an interview with RadarOnline.
According to Perrone, Davidson and Hewitt face a unique set of circumstances. Both work in industries that often require extended travel, filming commitments, and last-minute schedule changes. That reality could make a traditional custody arrangement difficult to maintain.
“Unlike more traditional cases,” Perrone explained, celebrity parents frequently deal with work obligations that can take them across the country or around the world. The lawyer noted that any future parenting agreement would likely need to be both detailed and flexible. Multiple residences and unpredictable schedules could require special provisions regarding travel, visitation, and decision-making responsibilities.
International considerations could also come into play. Because Hewitt is a British citizen and Scottie Rose was born in New York City, Perrone explained that any attempt to permanently relocate the child overseas would require Davidson’s consent or approval from a court.
Child support could present another layer of complexity. Since Scottie is still an infant, there is no established lifestyle history that courts often use when calculating support arrangements. Perrone suggested attorneys may instead need to project the standard of living the child would likely have enjoyed had the relationship continued.
The discussion sparked when Hewitt speculated about Davidson’s role as a parent as she suggested on social media that she was raising Scottie and managing expenses on her own.
After a fan questioned whether she was also handling the financial burden herself, Hewitt replied, “I am,” in a comment later deleted, according to People. The claim was quickly disputed by a source close to Davidson, who said the comedian has remained actively involved in his daughter’s life and continues to provide full financial support, including covering Scottie’s expenses while prioritizing her well-being.
