Mowitz, who is dating Kim Zolciak, points to Green’s deposition testimony. He says she described Biermann as a friend, said the two had met only once, and denied they were still in contact. According to his filing, she also testified that she expected no ongoing relationship and had no plans to bring him around her children.
Mowitz argues the record contradicts that. He says he later found Biermann’s vehicle parked outside the family home while the children were there. Text messages produced during the divorce show far more contact than Green acknowledged, he claims, and he says neighbors have told him Biermann visits often. He also cites photos TMZ published in May showing the two together.
His request rests on what he calls Biermann’s “unpredictable behavior” and an alleged history of mental and physical abuse involving adults and children. Mowitz asks the court to bar him from the residence and from any contact with the kids. Those allegations remain untested claims in a contested divorce.
The filing carries a separate request. Green holds exclusive use of the marital home under a temporary order, and Mowitz says his wine collection and weapons remain inside. He asks permission to enter, retrieve the weapons, inventory the wine and install a lock on the cellar.
Kim Zolciak entered this case last October, when Green subpoenaed the “Real Housewives of Atlanta” alum over gifts Mowitz allegedly gave her. Green has claimed he controls a trust worth more than $100 million. The RHOA star remains tied up in her own divorce from Biermann, which began in 2023 and continues to generate Real Housewives headlines.
