RHOP stars Robyn Dixon and Gizelle Bryant hit back at Eminem, challenging his appeal. The Reasonably Shady owners asked the federal trademark board to reject the rapper’s appeal.
Robyn Dixon and Gizelle Bryant asked the Trademark Trial and Appeal Board to reject Eminem’s latest appeal
Eminem filed against Reasonably Shady, arguing that the brand’s eyeshadow, lip gloss, makeup, and candles never reached shoppers. According to All Hip Hop, the legal team argued that the Real Housewives of Potomac stars reserved the product categories without any preparation for sale. They added that the lack of supplies, packaging, samples, and pricing showed insufficient preparation.
Now, Dixon and Bryant have responded by asking the federal trademark board to reject Eminem’s appeal. Their filing read, “[Eminem] waited nearly three years after receiving [Dixon and Bryant’s] discovery responses and taking Ms Dixon’s deposition before asserting an entirely new claim.”
“A later statement that [Dixon and Bryant] did not have immediate or foreseeable launch plans for certain products does not establish that [Dixon and Bryant] lacked a bona fide intent when the application was filed. The timing matters,” the filing said. The legal team claimed that their hoodies, hats, mugs, and shirts already had paying customers.
They added that Eminem is trying to rewrite their testimony regarding the 2022 trademark application. Eminem has opposed the trademark, saying that consumers could confuse it with his Shady brands.
The filing read, “[Dixon and Bryant] had an operating podcast brand and had used the mark in connection with consumer-facing merchandise, including hoodies, hats, shirts and tops, mugs, and autographed paddles. Those facts distinguish this case from one involving a party with no business, no brand, no audience, and no commercial activity. Cosmetics and candles are plausible extensions for a lifestyle, entertainment, style, and personality-driven brand.”
They argue that lipsticks and candles are the natural extensions of their brand.
Eminem is facing a trademark battle against Dixon and Bryant over the reality stars’ podcast name Reasonably Shady.
Eminem’s trial witness information is due on August 14 unless changes are made. The new filing has added another layer to the ongoing trademark battle.
