Megan Thee Stallion and Roc Nation will face a trial over a lawsuit filed by her former cameraman, Emilio Garcia. On Friday, Aug. 7, a federal judge ruled that the case can proceed with some of Garcia’s claims. The court rejected some of the claims and allowed others. Garcia filed the lawsuit against Megan and Roc Nation in 2024.

According to documents obtained by PEOPLE, the court dismissed Garcia’s retaliation claims under New York City and New York state human rights laws. The judge explained that Garcia was not engaged in a protected activity, and the court also rejected his claims under California’s Fair Employment and Housing Act. The judge found that Garcia did not face discrimination because of his sexual orientation.
Garcia can still pursue claims involving unpaid wages, state human rights law violations and several California labor code violations. His claims of unfair business practice are also still in the case. Garcia’s attorney, Ron Zambrano, thanked Judge Woods for reviewing the evidence. “Mr. Garcia is looking forward to having his day in court,” Zambrano said.
Zambrano also said his firm looks forward to presenting evidence for Garcia before a jury. The case will feature testimony from Megan and Roc Nation CEO Desiree Perez. Garcia’s complaint was filed in April 2024. He claimed Megan created an “unbearable hostile work environment” while he worked for her from 2018 to 2023.
Garcia also claimed Megan sexually harassed him and “fat-shamed” him. He alleged that she did not pay him correctly and breached multiple labour laws. Megan’s attorneys, Mari Henderson and Alex Spiro, denied his allegations in a May 2024 response. They called his complaint “almost entirely” false and described Garcia as a “con artist” trying to use the case to boost his singing career.
Garcia’s remaining claims will now move toward trial. The legal battle between the former cameraman and Megan will continue following the court’s decision.
