Things are moving forward in Erika Jayne’s lawsuit with Marco Marco designer Christopher Psaila. The Real Housewives of Beverly Hills star is facing allegations of wrongfully accusing the costume designer of charging her American Express card without her permission.
In 2017, Christopher was charged with wire fraud and aggravated identity theft, based on Erika’s claims. Those charges were eventually dismissed, but it caused irreparable harm to their design business.
Now, Christopher wants justice, and he just got one step closer to getting it.

The Marco Marco drama is playing out in two separate lawsuits. Fortunately, attorney Ronald Richards is still keeping track of all things Erika and Tom Girardi. He’s kept his finger on the pulse of this mess since it first began unfolding.
One of the lawsuits is from Marco Marco co-owner Marco Morante. He filed a suit in Florida, whereas Christopher’s is playing out in California. The last we heard of the former, Erika was facing a $300,000 default judgment.
Meanwhile, Christopher’s $18 million lawsuit accused her of making a false accusation against him. He also claimed she used her husband to bribe a Secret Service agent to pursue the unwarranted felony charges against him.
The RHOBH star followed up with an anti-SLAPP motion, hoping to have the case thrown out entirely. When that was denied, she tried to appeal. However, new court documents reveal that her appeal won’t move forward. That’s bad news for Erika, and a sigh of relief for Christopher.
“In the lawsuit against her in California by Marco Marco / Christopher Psaila, it was being stalled because Erika appealed the denial of her SLAPP motion. Now, the 9th Circuit has ruled, those are no longer appealable before trial,” Ronald explained.
For next steps, the court will set a trial date. It’s just the latest reminder that although Tom has been sentenced to prison time, Erika’s legal troubles are far from over.
