Lawsuit Against RHOBH Star Erika Jayne’s Attorney Thrown Out by Judge

Here’s one less lawsuit for Erika Jayne to worry about. The Real Housewives of Beverly Hills star is caught up in an ongoing lawsuit with two designers from Marco Marco, Christopher Psaila and Marco Morante. Years ago, Erika accused them of wrongfully charging her American Express for costumes they made for her. The accusations led to Christopher’s arrest and huge financial loss.

They’ve each filed their own lawsuits against Erika, and recently, they launched a new one aimed at her longtime friend and attorney, Jim Wilkes. They accused him of intentionally delaying bankruptcy proceedings and trying to stifle anyone challenging Erika’s role in Tom Girardi’s financial schemes. However, a judge just tossed out their claim.

According to court records reviewed by Bloomberg Law, a Florida judge dismissed Marco Marco’s lawsuit accusing Jim, claiming that it lacked specificity. In their complaint, they accused him of intentionally delaying the legal proceedings. They also claimed that Jim improperly funneled pandemic-era PPP loans into Erika’s pocket.

The judge found the complaint insufficient for multiple reasons. One of them was that they failed to disclose the citizenship of each LLC member to establish federal diversity jurisdiction. It’s a requirement for a federal case to determine that the plaintiffs and defendants are in separate states.

Additionally, the judge claimed that the business owners were “shotgun pleading,” meaning they were filing a lawsuit with “conclusory, vague, and immaterial facts” that weren’t connected to any specific claim. The judge said they used “tabloid headlines” instead of establishing a clear legal claim.

Although this wasn’t the result that Marco Marco had hoped for, they’re clear to file an amended complaint within 21 days. They could fix the mistakes and revisit this. Plus, both Marco and Chris have separate lawsuits in Florida and California, seeking damages for Erika’s alleged misconduct. The fight isn’t over just yet.
