A family law expert is weighing in on the revenge porn case involving Kelly Dodd. The former Real Housewives of Orange County alum is facing three misdemeanors including battery, in the matter. Rachael Bennett says that in cases like this, “intent is really the key element for a successful prosecution.”
She insists that the evidence must prove that intimate content was shared for the purpose of causing emotional pain. All the allegations against Kelly date back to last summer.

Apparently, there are a lot of moving parts to a case of this nature. Speaking to US Weekly Rachael says that “motive is absolutely key here.” In her eyes it could all “hinge on the circumstances that led to the circulation of these explicit images.” How the images were obtained is something she believes the judge will want to know.
Meanwhile “the history of the relationship between Kelly and the woman that led to the circumstances in the first place,” will also play a key role according to Rachael.
This all stems from an alleged incident in June of last year involving an unnamed person, along with disorderly conduct related to allegations that Kelly shared sexual images of another person without their consent in August 2025.
Per documents obtained by TMZ, prosecutors claim the reality star “unlawfully and intentionally” distributed the images. They reportedly depict a Jane Doe engaged in sexual activity. The allegations also claim that Kelly and the woman agreed to keep the images private.
Kelly has pleaded not guilty to the charges, so this matter will soon be headed to court. Rachael warns that Kelly should be very careful with her words in public in the lead-up to the trial. She says that should Kelly’s story ever change, clips or videos from her show could be used against her to “impeach her credibility.”
In a video from her program, The Rick & Kelly Show! last month, Kelly called the revenge porn charges “hilarious.”
