The dispute stems from a lawsuit seeking access to communications related to Carr’s public criticism of the late-night host following remarks made about conservative activist Charlie Kirk.

A government watchdog organization, Citizens for Constitutional Integrity, has filed a lawsuit against the FCC, alleging the agency failed to properly respond to a Freedom of Information Act request.

According to court filings obtained by RadarOnline, the group requested emails, text messages, Signal chats, and other communications containing terms including “Jimmy,” “Kimmel,” “Charlie,” “Kirk,” and “ABC” between September 10 and September 23, 2025.

The watchdog group claims the FCC produced no responsive text messages beyond a single screenshot that Chairman Brendan Carr allegedly emailed to himself. As a result, the lawsuit argues the agency failed to conduct a reasonable search of Carr’s cellphone and other messaging platforms.

At the heart of the controversy are comments Carr made after an episode of “Jimmy Kimmel Live!” in which Kimmel discussed the death of Charlie Kirk.

The complaint specifically references Carr’s public statement suggesting broadcasters could face additional scrutiny if concerns were not addressed. Critics argue that those remarks raised questions about whether conversations occurred behind the scenes regarding ABC or Kimmel’s show.

Citizens for Constitutional Integrity says the case is larger than one television host or one network. Instead, the group argues it is about government transparency and whether the public has the right to review communications involving a high-ranking federal regulator.

The filing seeks court intervention requiring the FCC to conduct a broader search for responsive records, including text messages and communications sent through messaging applications.

The lawsuit arrives months after controversy surrounding “Jimmy Kimmel Live!” sparked national debate over free speech, political commentary, and the relationship between government regulators and media organizations.
