Kristin Cavallari Accuses Jay Cutler Of “Marital Misconduct” In Divorce Papers

Kristin Cavallari and Jay Cutler promised an amicable divorce and claimed that they simply “just grew apart.” Obviously, no one believes that, especially since things got super ugly the very next day.

They are both coming out swinging with these divorce papers. Very Cavallari Season 4 is going to be pretty exciting, not that Jay would actually film. However, I do fully expect Kristin to dish on the split in between promoting her business ventures.

TMZ got a hold of the divorce documents. These two seem to be in complete disagreement about everything. She wants to get primary custody and give Jay visitation rights. However, Jay wants joint custody. This is pretty interesting since Jay was portrayed as a very present stay-at-home dad on Very Cavallari. However, Kristin adamantly denies that narrative in those court papers. She claims that she is the one who has always been the “primary residential parent.” Meanwhile, Jay has the opposite claim, saying that he is the “available at-home parent.”

This has barely started and it is already getting ugly. She accused him of “marital misconduct.” Is that just legal speak for cheating? Apparently, Jay “is guilty of such inappropriate marital conduct as renders further cohabitation unsafe and improper.” Unsafe? Wow. Kristin also denied that she engaged in marital misconduct, just in case he accuses her right back.

A “source” apparently told E! News that Kristin and Jay went to marriage counseling. This same person said the issues were “ongoing for a long time.” A different source claimed, “This was a buildup and a long time coming. It wasn’t a sudden decision and they have known for a while that things were headed in this direction.” Someone also cleared up why Jay and Kristin were in the Bahamas for a month right before they decided to divorce. This person told the E! Network, ‘They didn’t cancel the trip to the Bahamas because of the children. It was a pre-planned vacation and they didn’t want to spoil it for them.”
It’s worth pointing out that Very Cavallari is a show on the E! Network. More likely than not, someone from her camp was probably “inside source” one and two sharing those statements. There’s no way the network would share those claims without getting the OK from her.
