Nick Carter’s late brother, Aaron Carter’s wrongful death lawsuit has taken another unexpected turn. Newly filed court documents reveal one defendant plans to introduce previously undisclosed evidence during trial, evidence that could reshape arguments surrounding the late singer’s role as a father.
A new report details the child welfare investigation involving Aaron Carter
According to TMZ, Aaron’s dentist, Dr. Jason Mirabile, intends to present testimony from Department of Children and Family Services staff as part of his defense in the wrongful death case. The filing reportedly argues that the investigation is relevant to claims brought on behalf of Aaron’s son, Princeton.
Aaron’s family has argued that Princeton suffered the loss of his father’s companionship and future financial support following the singer’s death. But Mirabile reportedly plans to challenge those claims by introducing evidence related to the DCFS investigation. He also disputes assertions about Aaron’s role as a parent.
The dentist also reportedly challenged the family’s claim that Aaron was earning millions of dollars before his death.
According to the filing, there is no evidence the singer earned a seven-figure annual income before his death. It also argues there is no proof he would have maintained that income through future tours and other projects.
The lawsuit stems from allegations that Aaron’s doctor and dentist were negligent in prescribing Xanax before his death.
According to TMZ, Aaron died after overdosing on Xanax and an opioid medication, causing him to lose consciousness before accidentally drowning in a bathtub. The Los Angeles County Medical Examiner also determined that compressed gas inhalation contributed to his death. He was 34 years old.
The latest court filing comes ahead of a trial scheduled for October 2026 involving the remaining defendants in the case. Earlier this year, Aaron’s family reached a confidential settlement with other defendants connected to the lawsuit.
