dance moms kelly abby fight

Abby Lee Miller just beat bankruptcy and now she's being slapped with a lawsuit! After being slapped by Kelly Hyland

The Dance Moms star claims Abby is a bully who attacked her and she is seeking $5 million dollars is damages! The two erupted into a fight on this week's episode which culminated with Abby calling the cops on Kelly. Abby has since obtained a no-contact order.

Upon seeing how everything played out, Kelly is striking back by suing Abby and the producers for assault, defamation, and breach of contract.

In the suit, Kelly, who is beholden to the show through a Lifetime contract (according to Abby), claims she was tired of Abby's treatment of her daughters Paige and Brooke and was attempting to leave the rehearsal space when Abby "jumped in front of her and started yelling and lunged toward her."

In the court documents, nabbed by TMZ, Kelly alleges Abby was "gnashing her teeth loudly attempting to bite [me]." She attests, "Miller is a very large woman" who she believes "weighs around 300 pounds or so."

Kelly also says she only slapped Abby and pulled her hair in self-defense. Which, if you watched the show this week, kind of seems legit. You can catch a video of the incident below. After the fight was over Kelly states producers intentionally drove her away and put her on a plane "knowing police would issue a warrant for her arrest … and thereby create a juicy story line."

No word how the latest legal imbroglio will impact Kelly's standing on the show, but I'm thinking she's probably done, especially since she states in her suit she hasn't been getting paid regularly since the fight.

Abby has not commented thus far as she is grieving her mother's recent passing. She tweeted however that it was the State of NY vs. Kelly and she had nothing to do with the determination of charges being pressed.
