Another day, another update in the never ending legal battle between Gretchen Rossi and ex Jay Photoglou.
The latest news is that Gretchen, star of the Real Housewives of Orange County, is asking a judge to muzzle Jay from talking to the media about their legal battle, in which they are both suing each other for defamation, libel, amongst other claims.
According to Radar Online, Gretchen is seeking a protective order that would prevent Jay from discussing or disclosing “any information obtained through pretrial discovery, including her deposition.”
Jay is of course not happy with Gretchen’s filing with his lawyer, Bryan Freedman, stating: “Rossi has filed a motion for protective order. She seeks a protective order for all discovery she produces in this matter, including her deposition. We opposed the motion on numerous grounds including the fact that, while she seeks a protective order, she is simultaneously litigating the case in public and referencing to third parties (albeit inaccurate), statements allegedly made by Photoglou in his deposition.”
Jay also feels the request is offensive because “the protective order is patently unfair as it is one-sided and seeks to limit the public from knowing Photoglou’s side of the story only.”
A hearing for the protective order has been set for Thursday, June 2.
So far, Gretchen has found herself mostly on the losing end of this legal battle as she was forced to fork over $20k to Jay last year to help cover his attorney fees, and was then ordered to pay another $40k earlier this year – something she has reportedly yet to pay.
“Rossi has failed to pay those attorney fees per the Court’s order. She has snubbed her nose at the court order,” said Jay’s attorney. “Photoglou is in the process of taking further action against her to recover those fees, although it has yet to happen.”
Gretchen will likely have to go through a deposition if she doesn’t pay up the $40k. Her request is to prevent personal details from that from making it to the press, such as her earnings, her expenses, how much she actually received from her deceased fiance Jeff Beitzel, etc.
