Where Erika Jayne’s Legal Issues Currently Stand (May 2025)

Even though Erika Jayne is trying her best to move on from the legal allegations chasing her down, she still hasn’t managed to outrun the lawsuits. The Real Housewives of Beverly Hills star had a fantastic last season as she really was able to showcase her progress. However, the constant reminder of trials must be looming over her. Here is where she stands with all the lawsuits as of today.

Ronald Richards is hinting that Erika could be facing a jury trial by the end of the year regarding her $25 million lawsuit. Her estranged husband’s trustee filed a lawsuit against her in July 2021. The trustee, Elissa Miller, accused the Pretty Mess singer and her business, EJ Global, of using $25 million of the funds meant for former clients. Ronald noted that Erika had alleged that it was the LLC that owed the money. 

The lawyer took to Twitter, sharing, “The CA Franchise Tax Board already found this business to be a sham and only for tax deductions. We are hopeful that on June 4, 2025, the Court will set a jury trial.” Ronald went on to add, “Erika believes it will be a ten-day jury trial. Here are the relevant pages of the status report. Both sides want the case heard by this judge and not have any portions sent back to the bankruptcy court. We believe a trial will be set before the end of the year. This is clearly the greatest imminent threat facing Erika today.”

What lawsuits is Erika Jayne facing as of May 2025?

Along with the trustee suing her, Erika also has a few more outstanding lawsuits in multiple states. Her friend, Jim Wilkes, was representing her pro bono in Florida. He, however, missed an important court hearing that could end up costing her $300,000. The lawsuit was brought up by designer Marco Morante, who owns Marco Marco. Erika allegedly accused Marco and his partner, Christopher Psaila, of illegally overcharging her American Express. The duo countered and accused her of conspiracy. Marco is suing her in Florida, while Christopher has filed in California. 

Ronald also offered an update, explaining that Erika had hired a new lawyer in hopes the case would be dropped. He wrote, “Erika’s new attorney has wishfully assumed that the Court’s prior striking of the prior motion does not preclude a new motion to dismiss. For whatever reason, Morante’s attorneys didn’t move for default. Why not?” He added, “They are not providing a reason for not doing so for now. Does Morante want this case going on as long as the $25m fraud case against Erika? Jim has wisely given the torch to new counsel that didn’t drop the ball in the Florida case to avoid prejudice to his ward and client, Erika Girardi.”

While the lawsuits are troubling, there is a lot that Erika can do to concentrate on moving forward. Firstly, she is already taking her counsel’s advice and keeps her thoughts to herself. On more than one occasion, she has spoken about how she was waiting for the justice system to do its part. Erika also embraced her softer side during the Real Housewives of Beverly Hills Season 14. The singer even highlighted some of the positive changes over the last few years.

Firstly, she was able to reprise her role as Roxie Hart in Chicago. The blonde has really made an effort with her career. Not only was she back on Broadway, but she also traveled across the pond to Camden for a music festival. Erika also took part in Bravo’s social media campaign to announce that BravoCon 2025 would be back in Las Vegas. The Rollercoaster singer also spends time with people she cares about, including Teddi Mellencamp. Even though Erika still has a long way to go before she is in the clear, the reality star is trying to keep herself focused and let her lawyers take care of the legal issues.
