RHOP’s Wendy Osefo Claims Arrest Was ‘Illegal’

The court documents are in, and Wendy Osefo wants her charges thrown out. The Real Housewives of Potomac star is gearing up for her first day in court following her dramatic arrest alongside husband, Eddie Osefo.

In our first look at her criminal defense, Wendy and her lawyers claim that she was the victim of an “illegal” arrest. Due to “defects in the charging document,” they’re demanding that the court dismiss all of her charges. Her husband? That’s a different story.

Us Weekly reviewed court documents submitted by Wendy’s lawyer on October 17, just one week after she and Eddie were each arrested on multiple counts of insurance fraud, conspiracy to commit fraud, and making a false statement to a police officer.

According to the court filing, Wendy and her lawyer have issues with the way the cops showed up at the Osefo residence on the evening of October 9. The authorities poked around through the home and found several high-dollar items that the Osefos allegedly reported as stolen to both the police and insurance companies. However, Wendy and her lawyers want all of that evidence tossed out of the record.

The court documents urged that a judge reject “all admissions, statements or confessions,’ arguing that cops obtained them “unlawfully.” The filing also asked the court to suppress all evidence because of an “unlawful search or seizure.”

The RHOP star also demanded the suppression of wire and verbal communications because of an “unlawful interception.” Essentially, they believe that all of the elements of this case were executed illegally and shouldn’t hold any ground in court.

Additionally, the filing asked for the “trial of co-defendants be severed from the trial(s) of this Defendant.” That means she wants her case separated from her husband, Eddie. As of now, he doesn’t have a criminal defense attorney listed.

The husband and wife duo are due in court on November 7. Until then, they’re relying on their faith to get them through this. Ahead of the latest episode of RHOP, Wendy broke her social media silence with a post thanking God — and her fans.

“And through it all, GOD remains faithful,” she said on Instagram.. “Thank you for the outpouring of love, support, and prayers for myself and most importantly, my family during this time. We are forever grateful. Tune into @bravotv tonight for a new episode of #RHOP.”
