It’s been five years since Tom Girardi’s law firm Girardi Keese was first accused of embezzling clients’ settlement funds. The firm faced involuntary bankruptcy after being involved in what authorities called a “massive Ponzi scheme.” Tom’s now serving time in federal prison, following his conviction in 2024.
As his wife, Erika Jayne has been through it. The Real Housewives of Beverly Hills star’s feelings were mixed. Though she loved Tom, she was appalled that he could steal from people who trusted him.
Should she stand by him or divorce him? Last night on Watch What Happens Live, Erika revealed how she’s moving forward.
Erika Jayne says she has filed for divorce from Tom Girardi, despite rumors to the contrary
On WWHL, Andy Cohen asked the question raised by so many since this saga began. “Why haven’t you filed for divorce from Tom?” he wondered, sharing a fan question from Threads.
“Oh, I have,” the XXpen$ive singer quickly responded. “Yes, of course I have. I filed for separation.”
“It’s very difficult,” she continued, “to get someone who’s incompetent to divorce. I have to ask the conservator. It’s not that easy.”
When Tom was diagnosed in 2021 with late-onset Alzheimer’s Disease, his court proceedings became much more complicated. Divorce is complicated enough without one of the parties being declared incompetent.
Because of Tom’s memory loss and legal “incompetence,” he is unable to defend himself in court, making any proceeding difficult. In addition, there are no remaining shared assets to divide between Tom and Erika. Everything has already been liquidated to cover legal costs, not to mention the money owed to Tom’s clients.
“Have you thought at all about seeing him?” Andy asked Erika.
“I have,” she admitted, although she ultimately decided against reopening that wound. “It’s just too much … He’s done. You know, it is what it is.”
