Erika Jayne is living a life in limbo. The Real Housewives of Beverly Hills star is still trying to extricate herself from several civil lawsuits against her. She filed for divorce from Tom Girardi in November 2020. The matter is still ongoing.
Certainly, other matters have taken precedence, especially for the disgraced attorney. Tom was found guilty of four counts of wire fraud in August 2024. He is still awaiting sentencing, with competency being an issue. And for perhaps the same reason, the divorce has not gone forward.

Erika’s lawyer, Jim Wilkes, spoke on the issue in an exclusive interview with The U.S. Sun. He suggested that Tom’s declining mental state has prohibited any progress with the divorce.
“I don’t know that the divorce will go anywhere. He’s not competent to defend it. I don’t know that you could have a divorce in these circumstances,” he explained. In such a case, Erika may have to wait “until he dies.”
Jim continued, “Tom made a lot of mistakes, I get that, but I think he’s suffering from dementia. I don’t think he’ll live long. I think he is far beyond understanding what he’s being punished for. It makes me sad. I disagree with how it all happened.”
In January 2024, a judge declared Tom competent to stand trial. In August of the same year, he was found guilty of four counts of wire fraud.
“ To see Tom flying around the country trying to be evaluated by different centers for competence. It’s interesting,” Erika’s lawyer said of the matter. “He was competent enough for trial, but not competent enough to decide what to do with him. The court can’t even decide whether to put him in a medical facility or prison. What has anybody gained?”
Erika left the marriage with nothing
The marital separation was unfair to Erika. Her attorney said she did not get “a fair shot” in legal matters, and EJ left the marriage with nothing. She’s only recently settling into her downsized home.
“ It’s so easy to say that Erika did this or Erika did that. Erika was left with nothing in her name. Tom has nothing, what he had they found and they liquidated,” Jim explained.
